TransistorKit Terms of Service

These Terms of Service ("Terms") govern your use of the TransistorKit website at transistorkit.com, the account + licensing relay at app.transistorkit.com, the newsletter, and the Playground (together, the "Service"). The TransistorKit Mac application itself is licensed separately under the End User License Agreement — where these Terms and the EULA overlap, the EULA governs the app and these Terms govern everything else. By using the Service you agree to these Terms. If you don't agree, don't use the Service.
1. Who we are
The Service is operated by Emtanon Apps ("we", "us"). You can reach us any time at collector@transistorkit.com.
2. Eligibility + accounts
You must be at least 13 years old (and old enough to form a binding contract where you live) to use the Service. TransistorKit is a developer tool — it isn't designed for or directed at children.
If you create an account or activate a license, you're responsible for keeping your license key and access token safe and for everything that happens under your account. Tell us right away if you think someone else is using it.
3. Subscriptions, billing + refunds
Paid plans are billed through Stripe. By subscribing you authorize us (via Stripe) to charge your payment method on a recurring basis until you cancel. Cancel any time from Settings → Account → Manage Subscription; your plan stays active through the end of the current billing period, then stops renewing.
We offer a 14-day, no-questions refund from the date of purchase — email collector@transistorkit.com. If we change a plan's price, existing subscribers keep the price they signed up at; new signups pay the then-current price. Full licensing detail (device counts, gift/perpetual licenses, offline grace) lives in the EULA.
4. Acceptable use
When you use the Service, don't:
- Break the law, or use the Service to infringe someone else's rights — copyright, trademark, privacy, or otherwise.
- Probe, scrape, overload, or try to break the site or the licensing relay, or get around rate limits, activation checks, or device limits.
- Share, resell, sub-license, or transfer your license or access token to anyone else.
- Reverse-engineer the Service except to the extent local law expressly allows.
- Use the Service to build a product that competes directly with TransistorKit.
- Abuse the newsletter, support inbox, or Playground to send spam, malware, or harassing content.
We can suspend or terminate access if you violate these rules — usually with a warning and a chance to fix it first.
5. The software license
Installing and running the TransistorKit Mac app is governed by the End User License Agreement, which covers the license grant, what you can and can't do with the app and its AI output, production-safety expectations, and warranty/liability terms for the software. Please read it — accepting the EULA is part of setting up the app.
6. AI output is your responsibility
TransistorKit orchestrates third-party AI providers using your API keys; it doesn't make the models. AI makes mistakes. Generated code can have bugs or security holes, and generated images, music, voices, or dialog may infringe someone's rights even when they look original. You are responsible for reviewing everything before you ship it, and for any cost incurred against your own API keys. See the EULA for the detail.
7. Third-party services
The Service relies on third parties — Stripe for billing, Postmark for email, and the AI providers you connect (Anthropic, OpenAI, xAI, ElevenLabs, Apple, and others). Your use of those is governed by their terms, and they can change pricing, terms, or availability at any time. We don't control them and aren't responsible for their acts or outages.
8. Privacy
Our Privacy Policy explains what the Service receives (mainly licensing + billing metadata), what it deliberately never sees (your code, prompts, and generated output), and your rights over your data. It's part of these Terms.
9. Intellectual property
The TransistorKit name, logo, site content, and software are ours (or our licensors'). These Terms don't grant you any rights to our branding beyond using the Service as intended. What you build with TransistorKit is yours — your code is your code.
10. Service availability
We aim for high uptime but don't guarantee the site or the licensing relay will be reachable at any given moment. The Mac app has a 7-day offline grace window so already-activated devices keep working during a relay outage. We may change, suspend, or discontinue parts of the Service, and we'll give reasonable notice of material changes where we can.
11. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, to the maximum extent allowed by law. We don't promise it's uninterrupted, error-free, or that AI output will be correct or non-infringing. You use it at your own risk.
12. Limitation of liability
To the maximum extent allowed by law, our total liability to you for any claim related to the Service is capped at what you paid us in the previous twelve (12) months. We're not liable for indirect, incidental, consequential, or lost-profits damages.
13. Termination
You can stop using the Service any time; cancel a subscription from the Customer Portal. We can suspend or terminate your access if you breach these Terms. Sections that by their nature should survive — acceptable use, IP, disclaimers, liability, and governing law — survive termination.
14. Governing law
These Terms are governed by the laws of the State of Washington, United States. Disputes go to the state or federal courts in King County, Washington.
15. Changes
If we change these Terms materially, we'll update the date at the top and post a note. Continuing to use the Service after a change means you accept the updated Terms.
